 EB3 withouth H1b

Fellas, situation :-
-- Graduated 2012
-- Did not get picked for the H1b thrice
-- Currently F1 status masters with TPS
-- Company will pursue for H1b for next year as well
According to my research it seems that EB3 without H1B is possible as well so thinking about pushing company for EB3. Since the priority date is almost current for EB3 this looks like the easiest route

Can my company apply for EB3 and H1b(2015) at the same time ? What happens if I get picked on the lottery or get denied on the PERM process for EB3

h1b and EB category are completely separate process. You can apply and should definitely apply both. TPS should be able to cover you up for your EB process but its temporary and no one knows if this will be renewed(factually) but it does hold a strong ground for renewal. My personal advice, apply for H1b but start for the EB process ASAP.
You will have your GC in next 2 yrs at the latest.
And don't forget to invite me to the party.
